Case #1: Conspiracy against the State

In March, 2007, with the expiry of Dr. Alamgir's initial period of detention looming, the government filed treason-related charges to justify its continued imprisonment of Dr. Alamgir. The prosecutor failed to produce evidence, but referred to "secret files" with information. The High Court dismissed the case. Read this account of the exchange between the government prosecutor and the Court.


Parts of the exchange between the High Court Justice and the prosecutor was published in a Bengali daily newspaper on March 12. Here's a translation of that:

Honorable Justice: When was the conspiracy done against the State?
Deputy AG: At night.

Honorable Justice: The night begins at 7 pm. When exactly? 12 midnight? 1 am? 2 am?
Deputy AG gives no answer.

Honorable Justice: What were the accused doing?
Deputy AG: They were having a meal.

Honorable Justice: And then?
Deputy AG: And then they were conspiring.

Honorable Justice: Are there witnesses? Is there proof?
Deputy AG: Yes, we have all of that in a secret file.

Honorable Justice: Show me that file.
The Deputy AG stays silent. He is unable to show any file. He then says, "My Lord, we are now in a state of emergency."

Honorable Justice: During emergency, is having dinner with friends prohibited? Is it prohibited to visit one's in-laws? Is going to the bathroom prohibited?
Deputy AG does not say anything.

Honorable Justice: Have they brought out any leaflets or posters? Have they led any processions?
Deputy AG: No, they have not done these things.

Honorable Justice: Do you know that such charges was brought against the accused before? The High Court dismissed that case. Do you know that it is illegal to file the same case again after it has been dismissed? The Court hereby dismisses the case brought against Dr. Alamgir.

After the dismissal of this case, the government went to the Supreme Court and obtained a stay order against the High Court's verdict -- basically a ploy to buy time to frame some other charges.
